SUBSTITUTED TRUSTEE'S NOTICE OF SALE
STATE OF MISSISSIPPI
COUNTY OF SCOTT
WHEREAS, on the 27th day of October, 2003, Dianne Henry, a single woman, executed and delivered a certain Deed of Trust unto Fidelity National Title Insurance Company of New York, Trustee for Encore Credit Corporation, Beneficiary, to secure an indebtedness therein described, which Deed of Trust is recorded in the office of the Chancery Clerk of Scott County, Mississippi in Trust Book 668 at Page 656; and
WHEREAS, by various assignments on record said Deed of Trust was ultimately assigned to U.S. Bank Trust Company, National Association, as Trustee, as successor-in-interest to U.S. Bank National Association, as Trustee for the EMC Mortgage Loan Trust 2004-C, Mortgage Pass-Through Certificates, Series 2004-C by instrument recorded in the office of the aforesaid Chancery Clerk in Trust Book 1008 at Page 729; and
WHEREAS, on the 3rd day of April, 2023 the Holder of said Deed of Trust substituted and appointed Dean Morris, LLC as Substitute Trustee by instrument recorded in the office of the aforesaid Chancery Clerk in Trust Book 994 at Page 660; and
WHEREAS, default having been made in the payments of the indebtedness secured by the said Deed of Trust, and the holder of said Deed of Trust, having requested the undersigned so to do, on the 28th day of January, 2026, I will during the lawful hours of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale and will sell, at the south door on front steps of the Scott County Courthouse at Forest, Mississippi, for cash to the highest bidder, the following described land and property situated in Scott County, Mississippi, to-wit:
COMMENCING AT A PINE KNOT MARKING THE SOUTHEAST CORNER OF THE NORTHWEST 1/4 OF SOUTHEAST 1/4, SECTION 31, TOWNSHIP 5 NORTH, RANGE 6 EAST, THENCE RUN NORTH 00 DEGREES 06 MINUTES EAST, 861.47 FEET: THENCE RUN WEST, 531.19 FEET TO THE NORTH OR WEST RIGHT-OF-WAY OF TOWNSEND ROAD FOR THE POINT BEGINNING; THENCE RUN SOUTH 57 DEGREES 41 MINUTES WEST, 130.32 FEET ALONG SAID RIGHT-OF-WAY THENCE RUN SOUTH 64 DEGREES 44 MINUTES WEST, 377.92 FEET ALONG SAID RIGHT-OF-WAY; THENCE RUN SOUTH 56 DEGREES 36 MINUTES WEST, 333.67 FEET ALONG SAID RIGHT-OF WAY; THENCE RUN NORTH 19 DEGREES 29 MINUTES WEST, 210.86 FEET; THENCE RUN NORTH 215.87 FEET; THENCE RUN EAST, 800.79 FEET TO THE POINT OF BEGINNING, SAID TRACT CONTAINING 3.84 ACRES AND LOCATED IN THE NORTHWEST 1/4 OF SOUTHEAST 1/4, SECTION 31, TOWNSHIP 5 NORTH, RANGE 6 EAST, SCOTT COUNTY, MISSISSIPPI.
I will only convey such title as is vested in me as Substitute Trustee.
